Tootechnical Ltd Acceptable Use Policy

To use Tootechnical Ltd products and services, you must comply with the provisions of this Acceptable Use Policy ("AUP") at all times.

Please note that in this AUP "we"/"us"/"our"/"tootech" denotes Tootechnical Ltd, company number 03879909, registered office Rob Rendle & Co, Phoenix House, Stoke Village, Plymouth, Devon, PL3 4DF, England, and "you"/"your" denotes you the customer.

General

Our AUP has been drawn up based upon current best practices within the industry and those deemed acceptable in the internet community as a whole. This policy is liable to change without notice at any time. The current version will always be available from you corporate web site, http://www.tootech.net

Web Space

Tootech does not actively monitor the content of client web sites, therefore are unable to guarantee that all sites do not contain any illegal or other content that is classed as abusive or inappropriate to the community at large.

Illegal Content

Although the Internet is a global network, Tootechnical Ltd and it's clients are primarily governed by the laws of the United Kingdom. Although this is the case, it can often be the case that content that is legal within the United Kingdom is illegal in another country and visa versa. We therefore advise all customers that you seek independent legal advice if you have any concerns over the content that you publish on our systems.

It is also important to remember that items that are deemed unacceptable (and sometimes illegal) in the offline world, also applies to the Internet With this in mind, do not use any content in any form that you do not own or have the permissions to use.

You must not use our products and services that we offer you to publish or be involved in illegal activities.

Unacceptable Behaviour

You must make sure that if your site contains even any mild adult content, that the default pages on your web sit (i.e. index.html) must provide a warning of the content level contained within the site, allowing the visitor to leave the site without proceeding and viewing the content.

It is unacceptable for you to use our products and services to cause annoyance, inconvenience, offence or needles anxiety.

You may not publish personal and private details of others without their full consent.

You must not publicise, advertise, promote, distribute or link to any web page or content that contains information on illegal activities, virus creation and distribution, e-mail spamming software and hacking programs and information.

Your web site may not be used to distribute or advertise any of the following:

1. Software for sending SPAM (excessive news postings, bulk emails etc.).
2. Software for port scanning, virus creation, hacking or any other illegal or antisocial activity.
3. Lists of email addresses except where all the addressees have given their explicit permission.
4. Any collection of personal data other than in accordance with all applicable data protection legislation.
5. Links to websites hosting illegal content, including adult material.
6. Content designed to offend or cause needless anxiety to others.

You must not promote your web space, or encourage another person to do so, by any techniques that would be classed as abuse, e.g. spamming both by email and news group postings.

Abusive Emails

You must not use our systems to either send, receive or be perceived to send (by the use of header spoofing) abusive or inappropriate emails that people may find offensive. You should not send false messages or any other material which is distressing, grossly offensive, indecent, obscene, menacing or in any other way unlawful. Particular care should be taken to avoid any material which is offensive to people on grounds of gender, race, colour, religion or other similar categorisation. Always be sensitive to the fact that children might have access.

Spam (Unsolicited Bulk emails)

You must not use Tootech's email system to send unsolicited emails, bulk or otherwise. The sending of such emails is an abuse of the service and you will be in breach of the relevant terms and conditions. You should not also send emails where the sender or return address look like they have come via our systems by using header spoofing.

Security

It is important that at all times you should keep your security information private to your self. This includes the username, password along with the security Challenge Question and Answer. These precautions are for your own protection.

Tootech will take appropriate precautions to keep your personal information secure on our systems. We will also endeavour to only give the client access to your account. This is achieved by only allowing either the billing or administration contact access. We identify you by the username and password along with the security Challenge Question and Answer.

Actions Tootechnical Ltd Can Take

Your acceptance of this AUP and account terms and conditions are contractually binding. Any break of these agreement may result in suspension or termination of your account.

Offending and illegal material may be removed without prior notice or explanation. Clients engaging in abusive behaviour will be notified that their behaviour is unacceptable and has contravene the AUP. This may result in their account being suspended or terminated.

Tootech will comply with any law enforcement agency's requests for assistance against our users. We will provide any assistance that we can.

Account Restoration

A suspended account may be restored, at Tootech's discretion, upon receipt of a written undertaking by the abuser not to commit any future "abuse". However, Tootech will consider all cases on their individual merits. This activity may result in Tootech collecting from you any financial costs it has incurred in the activity on your account.
